This Consumer Health Data Privacy Policy explains how Staka, LLC ("Staka," "we," or "us") handles consumer health data belonging to people protected by Washington's My Health My Data Act and similar state laws. It supplements our Privacy Policy, which describes our practices for all personal information. "Consumer health data" means personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status.

1. CONSUMER HEALTH DATA WE COLLECT

a. Heart rate, only if you connect a heart-rate monitor.

b. Body measurements you enter: weight and height, and a history of changes to them.

c. Effort measurements from your sessions: power, cadence, speed, distance, duration, calories, and derived figures such as splits and training summaries.

2. WHY WE COLLECT IT

We collect and use consumer health data to run your workouts and the game's physics, to record your sessions and history, to operate races and leaderboards, including showing your effort to other skiers as described in our Privacy Policy, and to keep competition fair. Providing it is your choice: connecting a heart-rate monitor and entering your measurements are how you consent, and you can withdraw that consent at any time.

3. SOURCES

We collect consumer health data from you, from the SkiErg you pair, and from the heart-rate monitor you choose to connect. We do not obtain it from anyone else.

4. HOW IT IS SHARED

a. With other skiers, as part of multiplayer sessions, race results, and leaderboards, as described in our Privacy Policy.

b. With service providers who operate our infrastructure and may process it only on our instructions.

c. With Strava, only if you connect it and only in the activity files you choose to send.

d. Where required by law, to respond to lawful requests, or to protect the rights, property, or safety of Staka, our skiers, or others.

We have no affiliates. We do not sell consumer health data, we do not use it for advertising, and we do not share it with third parties for their own purposes.

5. YOUR RIGHTS

You have the right to: confirm whether we collect, share, or sell consumer health data about you; obtain a copy of it; obtain a list of the third parties with whom we have shared it; withdraw consent, by disconnecting your heart-rate monitor or discontinuing use; and have it deleted, by deleting individual activities or your whole account in the app (Settings, then Delete Account) or by emailing [email protected] from your account address.

To exercise a right, use the controls in the app or email [email protected] from your account email address; a request from your account address is how we verify it is you. We respond within the time the law requires, generally within 45 days. If we decline a request, we will explain why, and you may appeal by replying to our response; if your appeal is unsuccessful, you may contact the Washington State Attorney General.

6. CHANGES TO THIS POLICY

We may update this policy. When we do, we will post the updated version on this page and change the "Last updated" date, and for material changes we will also give notice on the website.
